13.6 Removal of the Chief Justice and the Judges of the Supreme

Court Article 101(2) — the impeachment machinery with its numbers: Grounds: serious violation of the Constitution or law; incompetence; misbehavior; failure in good faith; physical or mental incapacity; Initiation: one-quarter of the House of Representatives tables the motion; The 11-member impeachment recommendation committee (101(3)–(4)); suspension during the process (101(6)); the adequate-defence guarantee (101(7)); Resolution: two-thirds of a joint sitting of both houses; Consequences: no gratuity or pension; ineligible for further public position (101(9)); no bar to criminal prosecution (101(8)). The design note: removal of the highest judges is placed with the legislature — not the executive, not the Judicial Council: the world's post-authoritarian lesson (highest judges need political-insulation, and political removal needs supermajorities) institutionalised. HC and district judges are removable by the Judicial Council (142, 149 — incompetence, misbehavior, ill intent, code-of-conduct violation) with reasonable-opportunity safeguards — a lighter, professional track for the lower rungs.
