13.7 Jurisdiction of the Supreme Court (Article 133)

The constitutional-review jurisdiction (133(1)): any Nepali citizen may petition to declare any law void — for unreasonably restricting Part-3 rights or other inconsistency (including provincial law vs. federal law; local law vs. federal/provincial law); the Court voids ab initio or from the decision's date — the judicial-review engine (Unit 14's doctrines operate here); The original-extraordinary jurisdiction (133(2)–(3)) — the writ power: enforcement of fundamental rights; any other legal right with no other remedy, or an inadequate or ineffective one; constitutional/legal questions in disputes of public interest or concern (PIL's base — LAW 303) — through the five writs: habeas corpus, mandamus, certiorari, prohibition, quo warranto (Unit 9's anatomy); Parliament's internal affairs immune except want of jurisdiction; Appellate jurisdiction (133(5)): appeals from the High Courts; PIL judgments and constitutional-interpretation appeals; High Court references; Review jurisdiction (133(4)): review of its own judgments and interim orders — by judges other than the original bench; The satellite powers: case transfer-and-invitation (134 — public-importance questions; inter- HC impartiality transfers); contempt (128(4)); judicial administration and supervision over all courts (128(3)); and the Constitutional Bench (Article 137: the CJ + 4 justices) hearing the voidness petitions, the federal jurisdiction disputes (federation–province, province– province, province–local, local–local), and the federal/provincial election disputes — the stabilised five-judge chamber, a "constitutional court within the Supreme Court."
