7.3 Conditions for Adoption (the Current Law)

The Code 2074 and the Children's Act 2075's design — the triad: adopter's capacity, adoptee's eligibility, consents: Adopter: Minimum age, and the age-gap between adopter and adoptee (the protective arithmetic — an adopter sufficiently senior to stand as parent); The family-status rules (the childless adopter the paradigm; defined limits on adopting when one has children of the same status); Married adopters: the spouse's consent — adoption as a joint act (one spouse cannot adopt alone); Capacity-and-character: no disqualifying conviction, no trafficking-or-exploitation risk. Adoptee: A minor below the statutory ceiling; An orphan, an abandoned child, or a child whose parents consent — the adoptability certification in institutional cases (the child-care home's and the authority's clearance that the child is legally free for adoption); The child's own consent above the statutory age of discretion. Consents and prohibitions: The birth parents' (or guardian's) free, informed consent — revocable within the statutory window before finality; No adoption for immoral or exploitative purposes (the trafficking-and-labour bar — the Human Trafficking and Transportation (Control) Act, 2064's shadow); The frequency-and-duplicate-adoption bars; no confusion of prohibited degrees or rights- manipulation.
