6.2 Punishment for Disclosure

The disclosure's liability faces: The Criminal Code's state-secrets face: the person entrusted (by office or employment) with classified information who discloses it without authorization — the criminal offence (imprisonment and/or fine); the graver forms where the disclosure endangers security or is to a foreign principal; The official's disciplinary face: the civil servant's unauthorized disclosure as misconduct — the service discipline, separate from and alongside the criminal liability; The recipient's face: the media that publish leaked classified matter — the exposure: the publisher not "entrusted" by the state may sit outside the entrusted-official offence's core, but the publishing can still meet the offence's aiding faces, the contempt (Unit 7), and the tort/ privacy liabilities — the honest doctrinal note: the leaker clearly liable; the publisher's liability contested, turning on the publication's circumstances (the public-interest weight, the security harm); The RTI Act's penalties: the information officer's wrongful denial (the transparency's sabotage) and the wrongful disclosure alike penalized — the Act polices both directions: too much secrecy and too little care; The espionage/extremes: the classic espionage offences where the disclosure serves an enemy — the state secrets' darkest face.
