5.3 Juvenile Court (Bench and Adjudication Procedure)

The architecture: the juvenile court (the Children's Act 2075's command — the Gazette- noticed courts) with, until their full establishment, the juvenile bench in every district court — the district judge + a social-service provider + a child psychologist or child specialist (the multidisciplinary bench — the 2063 Rules' design continued); the mixed-case rule (the child-with-adult co-accused case to the regular court's procedure). The adjudication procedure: the closed proceeding (no public, no media, the identity's protection); the child-sized procedure (the simple language; the parent's presence; the right to be heard); the social study report's centrepiece role; the disposition menu (the juvenile's "sentence"): (i) admonition-and-warning; (ii) release on guarantee (the parent's undertaking); (iii) care-and-supervision orders (the parents, the relatives, the child-care home); (iv) compensation- and-restitution orders where appropriate; (v) the correction-home commitment — the custody of last resort, for the shortest time; and the bars: no capital, no life-without- release, no adult prison, the age-bands' reduced ladder; the timeliness discipline (the statutory limit for juvenile cases — the Supreme Court's enforcement line, Unit 6).
