6.1 Misconduct

The concept: the worker's (and — under the modern act's reciprocity — the employer's) breach of the employment's discipline — the wrongs that justify the disciplinary action. The misconduct's catalogue (the Act's classic heads): the wilful absence-and-desertion (the unauthorised absence beyond the tolerance); the insubordination-and-disobedience (the lawful order's refusal); the dishonesty (the theft, the fraud, the falsification — the false records; the forged certificates); the violence-and-fighting (the workplace's peace); the sabotage (the property's wilful damage; the production's destruction); the intoxication (the workplace's drunkenness-and-drugs); the bribery- and-corruption faces; the strike's illegalities (the unlawful strike's participation — the prescribed cases' world: the illegal strike's own graduated discipline); the harassment (the dignity's breach); the safety's violations (the protective discipline's disregard). The misconduct's test: the employment's nexus (the conduct's connection to the work — the off-duty conduct where the employment's reputation-or-function is touched); the standing-orders-and-rules' discipline (the enterprise's own codified rules within the statute's limits).
