3.2 Types of Asylum

Territorial asylum — the classic: the refuge within the state's territory (the physical shelter — the sovereignty's exercise); Extra-territorial asylum — the exceptional: the refuge outside the territory — at the embassies (the diplomatic asylum — the Latin-American tradition's institution; the Asylum Case (Colombia v. Peru, ICJ 1950): the diplomatic asylum NOT a general international right — the regional-and-consensual face), at the legations, aboard the warships (the maritime asylum); Temporary asylum — the time-limited refuge (the mass-influx's emergency shelter — Unit 7.1's face); De facto vs de jure asylum — the practice's shelter (the tolerated stay — Nepal's Tibetan face) vs the formal grant (the legal status's recognition). The regional faces: the Latin- American asylum treaties (the Havana 1928-and-Montevideo 1939 line — the diplomatic asylum's codification); the European-and-Asian practice (the territorial's dominance).
