4.2 Void Contracts

The voidness' ground (the contract's nullity from the start — ab initio): (i) the insurable interest's absence (the gambling-policy's voidness — the subject's lawful interest's requirement; the life's exceptions: the own-life-and-dependants' faces); (ii) the illegality (the unlawful subject — the smuggled goods' cover; the criminal enterprise's insurance); (iii) the public policy's bars (the immoral-or-anti-social covers); (iv) the non-est risk (the impossible subject — the already- lost property's "insurance" — the fortuity's absence); (v) the fundamental-formation failures (the parties' incapacity; the consensus's total absence). The consequences: the nullity — the policy's never-existence (the claim's denial); the premium's return (the unjust-enrichment's correction — the innocent party's restitution: Unit 5.2's craft); the voidness's proof-burden (the insurer's — the repudiator's duty).
