3.10 WCT and WPPT, 1996

The WIPO internet treaties: the WIPO Copyright Treaty (WCT) (the Berne's digital update: the computer programs' confirmation; the databases' craft; the right of communication to the public (the on-demand's-and-the internet's right); the anti-circumvention (the TPMs' technological- protection measures) + the rights-management information's integrity)); the WIPO Performers and Phonograms Treaty (WPPT) (the performers'-and-producers' digital faces (the making- available-of-sound-recordings)); the pair's role (the internet-era's response (the digital agenda's foundation)). Exam Focus Long questions (the conventions' bank): (i) The Paris Convention (the national- treatment + the priority — the banker); (ii) The Berne Convention (the automaticity + the minimum standards); (iii) The TRIPS (the standards-enforcement-flexibilities trio). Short questions: the right of priority; the Article 6bis well-known marks; the Nice Classification; the WCT's anti-circumvention. Trick areas: (i) Paris = INDUSTRIAL property; Berne = COPYRIGHT — the two constitutions (the swap error); (ii) The priority windows: 12 months (patents) vs 6 months (marks/designs); (iii) TRIPS' innovations = the ENFORCEMENT + the WTO-DSM teeth (the earlier conventions' absence); (iv) Rome 1961 = the RELATED rights (not the authors'); (v) Nepal's membership: Paris 2001 + Berne 2006 + TRIPS 2004 (the three dates' sequence); (vi) The UCC = the largely-historical alternative (the ©-notice world).
