3 Human and animal behaviour

Human behaviour is learned and symbolically mediated: we act according to meanings that are shared and can be argued about. Animal behaviour is largely instinctual and transmitted genetically, though higher animals do learn by imitation. The difference that matters for law is the capacity to follow a rule as a rule — to understand that a norm applies because it is a norm, not merely to imitate what others do.
