The Foreign Investment and Technology Transfer Act provides for approval, defines the sectors open to foreign investment, guarantees repatriation and grants treatment in accordance with law. Nepal's bilateral investment treaties then add the international layer; the choice of forum in those treaties decides whether a dispute goes to a Nepali court or to arbitration, and that choice is often the most valuable clause in the instrument.
