Discuss (a) Factum probans

The fact — the thing, the state, the relation — the existent (or non-existent) that the senses perceive: the physical facts (the act, the object, the place) and the psychological (the intention, the knowledge, the motive). The factum probans vs the factum probandum: the fact-to-be- proved (the issue) vs the fact-proving (the evidence). The facts' forms: the positive-and-negative (the act-and-the-omission); the direct-and-indirect (the issue's core vs the inference's bridge).
