6.2 Burden of Proof with Plaintiff

The general civil rule (U2.4's principle): the plaintiff proves the claim's facts (the cause's elements); the defendant's counter-claims' reversal (the defendant-as-plaintiff for the counter). The plaintiff's failure's consequence (the dismissal — the unproved claim dies); the defendant's no- proof luxury (the defence's option — the plaintiff's case alone tested; the defendant's own assertions needing proof when raised).
