2 Ignorantia Juris Non Excusat (Ignorance of the Law Is No Excuse)

The rule: a person cannot escape criminal liability by pleading ignorance of the law. Publicity of statutes (Official Gazette publication) creates a legal presumption that every person knows the law — a fiction, as everyone concedes, but a necessary one: were ignorance a defence, every trial would dissolve into unanswerable questions of personal knowledge.The doctrine's limits and qualifications (where the examination's marks live):1. Ignorance of foreign law is treated as ignorance of fact (a Nepali in India genuinely unaware of a local rule may argue mistake — see mistake defences, Unit 7);2. Mistake of law caused by an official's misleading interpretation — in some systems (the US's Cheek-type and official-publication cases) reasonable reliance on an authoritative interpretation can defeat liability; codes increasingly provide relief where error was inevitable;3. Ignorance negating mens rea: where a statute requires knowledge of unlawfulness as part of the offence itself, ignorance of the legal rule (as distinct from the factual situation) may genuinely negative the mental element;4. Distinction from mistake of fact: mistake of fact (I thought the buffalo was mine — genuinely) can exculpate by negating intent; mistake of law (I knew the buffalo was his but thought taking it lawful) classically cannot.
