Asylum is the protection a state grants on its territory (or in places under its authority) to a person fleeing persecution or prosecution — shelter from the authority of the persecuting (or demanding) state. Its juridical structure (the unit's master distinction):1. The right to grant: every state, by virtue of territorial sovereignty, may grant asylum — to receive and shelter whom it wills (a sovereignty function, erga omnes defensible);2. No matching right to receive: the individual has (UDHR Article 14) a right to seek andenjoy asylum — but no international-law right to be granted it (the granting state's discretion), the deliberate compromise of the UDHR's drafting;3. Asylum vs. non-refoulement: asylum is the positive shelter; non-refoulement (Unit 5) is the negative duty not to return to danger — the latter increasingly customary, the former still discretionary in general international law.
