2 Types of Asylum

1. Territorial asylum: granted on the state's own territory — the asylum-seeker within the granting state's sovereignty; the regular case, governed by the state's law and the refugee regime where applicable;2. Extra-territorial asylum: granted in places beyond the territory but under the state's authority — the exceptional and contested form: - Diplomatic asylum (asylum in embassies and legations) — recognized in regional law (the Latin American tradition: the Montevideo and Caracas Conventions — a century of practice: Haya de la Torre himself) but not a generalcustom — the ICJ's holding in the Asylum case (Colombia v. Peru, 1950): Peru's grant of diplomatic asylum to Víctor Raúl Haya de la Torre; the Court held diplomatic asylum exceptional, requiring proof of a regional custom binding both states (and Colombia's unilateral qualification of the offence as "political" was invalid); - Asylum on ships and aircraft (warships as floating extensions of flag sovereignty — merchant ships cannot grant general asylum) and in military camps abroad;3.
