4 Guardianship and Curatorship

1. Guardianship (of the person): for minors without parental care (orphans; the parents' incapacity-and-absence) and for persons of unsound mind / intellectual-and- psychosocial disability (the adult guardianship's protective-and-rights-based tension); the statutory order of guardians (the surviving parent; then the near relatives; the court-appointed guardian); the ward office's-and court's appointment machinery (the Children's Act's guardianship framework; the district court's inherent jurisdiction); the guardian's duties-and- accountability (the child's property-and-welfare; the removal grounds); 2. Curatorship (of the property): the guardian-of-property distinction — the minor's-and- disabled-person's estate management (the "curator" of the civil-law tradition): the inventory- and-accounting duties (Unit 6's inventory); the court's supervision-and-approval for major transactions (the minor's immovable property — no sale-and-mortgage without the court's sanction); the curatorship's Nepali practice: the guardian often cumulating person-and-property roles under the court's eye — the exam's distinction to keep clean: guardian = person; curator = property; the Nepali courts' combined-function practice.
