3 Sources of Contract Law

1. In Nepal: the Muluki Civil Code 2074, Part V (16 chapters: the general contract law + the nominate contracts — sale, lease, hire-purchase, guarantee, loan-and-pledge, agency, jyala- majduri the wage-work contract, and the rest); the special statutes (the Electronic Transactions Act 2063 for e-contracts; the Arbitration Act 2055 as amended; the repealed Law of Contract Act 2023 and Contract Act 2056 as the Code's statutory ancestry; the Consumer Protection Act 2075; the Labour Act 2074 as the labour-contract's lex specialis; the Public Procurement Act 2063 for the state's contracts); 2. Precedent: the Supreme Court's contract jurisprudence (the prescribed cases of this syllabus — the doctrine's living source); 3. Custom-and-usage: the trade customs and the mohiyya practices (their provability-and- incorporation); 4. Comparative-and-international: the CISG, the UNIDROIT Principles, the Indian Contract Act 1872's historical shadow on South Asian practice; the general principles of law (PIL-I's Article 38(1)(c) family).
