3.6.1 The Patent, Design and Trademark Act, 2022 (Industrial Design related Provisions) The Nepali design regime (by name-and-effect): the application's-and-the-deposit's requirements (the representations-and-the specimens of the design); the examination-and-registration by the Department of Industry (U7.1's administration); the term-and-renewal discipline (the Act's periods-and-extensions); the infringement-and-penalty faces (the complaint's-and-the fine's-and- the-compensation's machinery); the convention-priority's implementation; and the honest critique — the Act's 1965 vintage (the design regime's age against the industry's needs; the examination capacity's thinness; the Industrial Property Bill's long-pending modernisation with the design's- and-GI's upgrades). 3.6.2 WIPO Administered Treaties relating to Industrial Design The Hague Agreement (the international design registration: the single-application-and-the- designated-states' system — the WIPO's deposit-and-registration services of U1.6.3); the Paris Convention (the industrial-property base: the six-month priority-and-the-nationals' treatment — U1.6.2's detail); the WIPO's standing-committee's law-development faces for the design's modern agenda (the 3D-printing-and-the digital-design's questions). 3.6.3 TRIPS Agreement (Industrial Design related Provisions) The Article 25 standards: the independently-created, novel-or-original designs' protection; the exclusions' option (the technical-or-functional designs' bar); the textile designs' special care (the cost-and-search-and-availability's mandate — the fashion's-and-the fabric's sector's access); the Article 26 rights: the making, selling, offering-and-importing's exclusivity; the limited exceptions' discipline (the equitable-and-the legitimate-interests tests); the duration's minimum of ten years — the TRIPS floor the national laws meet-or-exceed.
