Nepal is not a party to the 1951 Convention, though it has hosted large refugee populations and has allowed the UN refugee agency to operate and to conduct status determination. The legal position is therefore governed by the general law — foreigners, entry and residence — read together with the constitutional right to equality and the obligation not to return a person to torture, together with the principle of non-refoulement, which is treated as binding beyond the treaty.
