1 Why media law is constitutional law in action

The press is the practical form of the freedom of expression. Almost every media law question is therefore a conflict between that freedom and another interest — reputation, privacy, national security, public order, the fairness of a trial — and the test applied is proportionality: is the restriction prescribed by law, does it pursue a legitimate aim, and is it necessary and proportionate?
