4 The limits

Liability is not unlimited. A state is not the insurer of every risk; the duty to protect must be a real duty, breached in a way that caused the harm. The difficult case is the omission: an authority had information, did nothing, and the harm followed. Courts ask whether the risk was foreseeable, whether the authority had the power to act, and whether the failure was of a kind the law recognises.
