5.3 Bar-Bench Relations

Meaning: the professional relationship between the Bar (advocates as a body) and the Bench (judges as a body) — the two working halves of the justice system. Justice is produced by their collaboration; it collapses with their conflict.The classical ideal:independence with mutual respect.1. Independence of the Bar — advocates must be free to take unpopular cases and criticise (fairly) — the first defence of liberty;2. Independence of the Bench — judges must decide free of pressure, including pressure from lawyers (strikes, intimidation, boycotts);3. Respect — advocates address the court with courtesy; judges treat counsel and parties with dignity and patience; neither tolerates personal criticism of the other;4. Cooperation in procedure — candid pleading, agreed facts where possible, disciplined cross- examination, punctuality — all shorten litigation. Bar and Bench cooperate in casemanagement, legal-aid schemes, continuing education and court-reform committees;5.
