2 Theories of Recognition

1. Constitutive theory (Oppenheim's classic position): recognition creates statehood — a new state exists as an international person only through the recognition of existing states. Strength: explains why unrecognized entities (Northern Cyprus, Somaliland) languish in legal limbo. Critique: incoherent (unrecognized state A vs. recognizing state B are both right?); retroactivity paradoxes; and the unacceptable veto of hostile powers over a people's statehood.2. Declaratory theory (Hall, and the modern mainstream): statehood exists when the Montevideo criteria are met; recognition merely declares (acknowledges) the fact. Support: Article 3 of the Montevideo Convention ("The political existence of the state is independent of recognition by the other states"); the EC's Badinter Opinions (Yugoslavia's dissolution — the fragments' statehood by effect of the criteria); the Tinoco arbitration's recognition-independent validity of governments.3. The synthesis for answers: statehood is declaratory (law) but participation in the system is constitutive in effect (politics): recognition governs the relations (immunities, standing, treaties' operation), not the existence — the doctrine the community practice of collective non- recognition refines: illegal entities may meet effectiveness and still be denied legal existence (ex injuria jus non oritur — Rhodesia, the 2014 annexation of Crimea).4.
