6 Emergency Power (Article 273)

1. Declaration: by the President on the Cabinet's written recommendation — for war,armed rebellion, or violent revolt threatening Nepal's sovereignty, territorial integrity or security (and the severe-economic-breakdown variant for the financial emergency — the clauses' remuneration-provisos family: Articles 130, 141, 149 etc.);2. Parliamentary control: approval by ⅔ of the existing members within one month (the declaration lapses otherwise); renewable for further 3-month periods on the same majority; the HoR's term extendable up to one year (Article 85(2));3. The rights floor (the exam's crucial point): even in emergency, habeas corpus is notsuspended; the specified non-derogable rights and the demand: any act done in bad faith is compensable (the compensation clause); the 2015 design's deliberate contrast with the 1962/2047-era emergency practice and with India's Article-359 suspension model;4. The provincial dimension (Article 162(1) proviso; 232): provincial executive's functions passing to the Provincial Head in emergency/federal rule;5. Judicial control: emergency declarations reviewable (the proportionality-and-good-faith reading of the compensation clause; the Court's historical practice of scrutinizing emergency- era detentions).
