Family law is the body of law governing the constitution, incidents and dissolution of familyrelationships — marriage and its validity, the rights and duties of spouses, parent-child relations (legitimacy, adoption, guardianship, custody), matrimonial remedies (separation, divorce, maintenance), and the family's property regime (joint-family property, partition, inheritance). Its unit of regulation is not the individual but the relationship — which is why family law is called the most intimate of legal disciplines: the state regulating the household. Its sources historically: religion and custom (the Dharmashastra, customary practices of the hills and the Tarai); its modern source: the civil statute — in Nepal, the family chapters of the Muluki (National) CivilCode, 2074 (2017).
