5.5 Right and Duty between Parents and their Children

The reciprocal catalogue: Parents owe children: Maintenance — food, clothing, shelter, education, health care — according to means (below); Nurture, protection and care — the Children's Act 2075's parental-duty catalogue; protection from abuse, exploitation and neglect (the removal-and-alternate-care machinery where parents fail); Guardianship and management of the child's person and property until majority (Unit 6); court sanction for major transactions in the child's immovable property; Equal treatment of all children (no discrimination by birth status or gender); Identity acts — birth registration, name, citizenship facilitation. Children owe parents: Maintenance of aged and infirm parents — the Code's reciprocal duty: the adult child's maintenance obligation, enforceable by the parents' maintenance suit (a growing docket of practice as Nepal ages); Respect and care — the moral duty the law touches lightly, save in the abandonment-and- neglect offences. Between them: the succession rights each direction (the child inheriting from parents — Unit 9; the parents as heirs of the predeceasing child).
