UNCTAD does not make law. Its importance is of three kinds: it produces the empirical record that negotiations use; it articulates the claims of developing states (special and differential treatment, preferential access, technology transfer); and its compendia and model instruments are the drafting material for national legislation and bilateral treaties. For a Nepali lawyer its investment and trade-law database is often the only accessible source for the text of another state's investment law or of an older bilateral treaty.
