3 Nature, function and scope

Its function is to convert a private arrangement into an enforceable obligation: it fixes what is to be done, when, by whom and at what cost, and provides a remedy if it is not done. Its scope extends from a sale of goods to a lease, an insurance policy, a loan or an employment relationship.
