Contract law is no longer wholly private. Equality norms prohibit terms that discriminate; labour standards limit the freedom to contract for less than a minimum wage; the prohibition on forced labour makes consent a real question where a worker is bonded; and consumer law imports standards of fairness into standard-form contracts that nobody negotiates.
