Airspace is the column of air above a state's territory, including its territorial sea. The starting point of modern air law is that every state has complete and exclusive sovereignty over the airspace above its territory. That sovereignty explains everything else: a foreign aircraft may enter only with permission, given generally through the Chicago Convention's provisions on non-scheduled flight and specifically through bilateral agreements for scheduled services.
