Unit 6: Juvenile Justice System in Nepal
6.1 Investigation in Juvenile Delinquency
The investigation’s juvenile face: the specialised police units (the Women-and-Children Service Centres and the directorate’s line — the trained investigators); the child-friendly inquiry discipline of the Juvenile Justice (Procedure) Rules 2063 — the questioning in a suitable environment, limited in stretch (not more than an hour at a sitting, never at night), the parent’s-or-guardian’s-or-social-worker’s presence, no coercion (the confession’s juvenile fragility — Unit 1.3’s suggestibility), no handcuffs-or-uniform display, the custody separated from adults; the age determination (the birth registration, the school records, and where they fail — the ossification-and-dental-bone examination practice, the trafficking-victim’s misaging disputes); the FIR-and-investigation’s speed discipline; and the diversion’s police-level face (the minor offence’s warning-and-release-and-family-referral route — the Children’s Act 2075’s discipline).
6.2 Prosecution of Juvenile Delinquency
The prosecution’s juvenile care: the government attorney’s specialised sensitivity (the child’s counsel-and-parent presence at the statement); the charge-sheet’s juvenile form (the social-background annex; the offence’s-and-child’s separation); the age dispute’s resolution (the medical-and-documentary evidence — the prosecution’s burden of the child’s privilege); the prosecution’s discretion — the withdrawal-and-diversion faces for the trivial; and the trial-preparation’s protections (the child-witness’s handling — the Mahesh Kumar Chaudhary line’s lesson that a child’s cross-examination cannot be read like an adult’s). The prosecution’s aim in the juvenile frame: the least formal adequate response — the state as the child’s corrector, not destroyer.
6.3 Adjudication and Disposition of Juvenile Delinquency Cases
The adjudication’s architecture: the juvenile court (the Children’s Act 2075’s Section 30 command — the Gazette-noticed courts) with, until their full establishment, the juvenile bench in every district court — the district judge with the social-service provider and the child psychologist/child-specialist
