3.1 Rules of Interpretation
The rules’ geography: the primary three (the grand methods), the secondary maxims (the linguistic presumptions), and the Mimansa (the indigenous science) — then the subject-matter overlays (the statutes of special kinds).
3.1.1 Primary Rules of Interpretation
(i) Literal rule. The words’ plain, ordinary, grammatical meaning — the intention’s discovery through the language itself. The classic statement’s direction: the judges declare the law as it is; if the result is inconvenient, the remedy is the legislature’s (the Sussex Peerage case’s discipline — the Sussex Peerage case). Merits: certainty, the separation of powers’ respect. Demerits: the absurdity-and-hardship cases (the literal path’s famous injustices).
(ii) Golden rule. The literal rule’s modification: the ordinary meaning unless it produces absurdity or repugnance — then the modification the words bear (the Grey v. Pearson-and-London & North Eastern Railway v. Berriman line — by name). The golden rule’s narrow form (absurdity’s avoidance) and broad form (the injustice’s correction — the more adventurous vein).
(iii) Mischief rule. The oldest purposive method — the Heydon’s Case (1584) four questions: (1) what was the common law before the Act? (2) what mischief and defect did it not remedy? (3) what remedy did Parliament appoint? (4) the true reason of the remedy? — the construction that suppresses the mischief and advances the remedy. The modern era’s bridge: the mischief rule grows into the purposive approach (the Smith v. Hughes lore; the constitutional era’s adoption).
3.1.2 Secondary Rules of Interpretation
(a) Ejusdem generis. “Of the same kind”: the general words following the specific ones take the specific list’s genus (the “dogs, cats and other animals” logic — the general words read as the list’s kindred). The conditions: the specific list’s existence (at least two specifics), the genus’s discernibility, the catch-all’s following.
(b) Noscitur a sociis. “Known by its companions”: a word’s meaning gathered from its neighbours (the doubtful word coloured by the company it keeps).
