Syllabus coverage in this unit
1.1 Meaning of Public Finance · 1.2 Meaning, Concept, Nature of Fiscal Laws · 1.3 Brief History of Fiscal Legislation in Nepal · 1.4 Fiscal Policies of Nepal

1.1 Meaning of Public Finance

Public finance — the state’s money-science: the revenue’s raising (the taxes and the borrowing), the expenditure’s spending (the services and the investments), and the deficits-and-debt’s management — the government’s household at the nation’s scale.

The discipline’s four branches (the lawyer’s map):

  1. The revenue law — the taxes (the income tax, the VAT, the customs, the excise — Unit 3 and Unit 6’s world);
  2. The expenditure law — the budget-and-appropriation (Unit 5’s world);
  3. The debt law — the loans and the guarantees (Unit 4’s world);
  4. The fiscal-administration law — the departments, the accounts, the audit (Units 5-6).

1.2 Meaning, Concept and Nature of Fiscal Laws

Fiscal law — the public finance’s LEGAL frame: the rules governing the state’s revenue-expenditure-debt — the fiscal power’s exercise AND its limits.

The nature (the character’s four faces):

  1. The public-law core — the state-and-citizen relation (the tax’s compulsion; the spending’s duty), not the private bargain;
  2. The statute-centred discipline — the annual statutes (the Finance-and-Appropriation Acts) riding on the permanent codes (the tax Acts) — fiscal law is WRITTEN law above all;
  3. The technical-and-policy blend — the law serving the economics (the rates, the bases, the formulas — the lawyer must read a budget);
  4. The constitutional foundation — the fiscal constitution (Unit 2): the money-powers’ distribution among the three tiers, the parliament’s monopoly, the audit’s capstone.

The fiscal power and its limitations (the concept’s completion): the state’s power to take-and-spend — the taxing power (the compulsory taking, the sovereignty’s oldest attribute), the spending power, the borrowing power — limited by: (i) the constitutional limits (the no-taxation-without-law principle; the annuality; the appropriation’s discipline; the federal division); (ii) the rights’ limits (the property’s respect, the proportionality); (iii) the political limits (the parliament’s control; the electorate’s answer); (iv) the international limits (the treaties’ constraints).

1.3 Brief History of Fiscal Legislation in Nepal

The line (the tour — with the Act-years as the stations):

  1. The pre-modern world — the land-centred revenue (the jagir, birta, kipat tenures’ assignments; the land revenue and the customs’ ancient faces; the jhara exactions) — the Rana-era land revenue’s world;
  2. The 1950s-60s turn — the modern budgeting’s beginning; the early income-type taxation’s introduction; the 2019 B.S. Foreign Exchange Regulation (the controls’ code); the Audit Act 2019’s early face;
  3. The 1970s-80s patchwork — the sales tax, the contract tax, the hotel tax; the Land Revenue Act 2034; the Financial Administration Provisions-era rules (the pre-IGFA world);
  4. The 1990s revolution — the Value Added Tax Act 2052 (1996) (the tax modernisation’s milestone); the income-tax reorganisation;
  5. The 2000s consolidation — the Income Tax Act 2058 and the Excise Duty Act 2058 (the modern codes); the Customs Act 2064;
  6. The federal redesign — the Constitution 2072’s fiscal federalism (the three-tier powers; the NNRFC); the Local Government Operation Act 2074 and the Intergovernmental Fiscal Arrangement Act 2074 (the operating statutes); the Economic Procedures Act 2074 (the budget execution’s code); the new Customs Act 2081 (2024).

1.4 Fiscal Policies of Nepal

The policy’s record (the honest review — the exam’s paragraph):

  1. The liberalisation’s turn (the 1990s) — the VAT’s adoption as the modernisation’s centrepiece; the tax administration’s rebuilding;
  2. The federalism’s redesign (2072-) — the three-level budgets; the revenue sharing; the NNRFC’s machinery;
  3. The present aims — the tax-GDP ratio’s lift (the low ratio’s chronic critique); the taxpayer-registration and digitalisation drives (the e-filing, the e-invoicing);
  4. The expenditure’s faces — the recurrent’s weight (the salary-and-debt-service burden); the capital’s aspiration (the infrastructure’s build);
  5. The deficits-and-debt — the domestic borrowing’s rise; the sustainability’s watch; the guarantee-contingent liabilities;
  6. The federal-transfer dependence — the provinces’-locals’ own-revenue weakness (the equalisation’s burden);
  7. The reform agenda — the tax-amnesty cycles’ debate (the equity’s cost); the mid-term-expenditure discipline; the PFM modernisation (the FMIS’s line).

Exam Focus

  • Long questions: (i) The meaning of public finance and fiscal law — the four branches + the nature’s four faces + the fiscal power’s limitations; (ii) The history of fiscal legislation (the Act-years as the stations — 2052, 2058, 2074 as the anchors); (iii) Nepal’s fiscal policy — the review’s seven heads.
  • Short questions: the fiscal power; the annuality rule; the tax-GDP ratio; the divisible pool.
  • Trick areas: (i) Fiscal law is the FRAME (the constitution, the procedure, the audit) — the tax statutes’ technical detail lives in Taxation Law (LAW 309); answer this paper’s questions at the fiscal-law level; (ii) The Finance Act is ANNUAL, the tax Acts are PERMANENT — the two-layer reading (LAW 309’s doctrine) belongs to this course’s foundation too.
