Why this matters for law students
- IMPORTANT: there is currently no separate 'child court' website, and standalone juvenile courts have not been fully established
- Section 30 lets the Government of Nepal, on the recommendation of the Judicial Council, form juvenile courts by Nepal Gazette notification. Until they exist, a Juvenile Bench operates in every District Court
- A Juvenile Bench is composed of the District Judge plus a social service provider and a child psychologist or child specialist, exercising jurisdiction collectively
- A child is anyone who has not completed 18 years. Hearings are in camera, child-friendly, and based on continuous hearing
- Cases are generally to be disposed of within 120 days of filing
- Diversion is available at any stage of proceedings; a social study report must accompany the charge sheet
- In March 2024 the Supreme Court directed the executive to establish juvenile courts, after earlier orders going back to 2005 went unimplemented – track this area for change
