6.5 Diversion

The pre-formal exit: the diversion of the child from the formal system at the police, prosecution and court levels (the Children's Act 2075's discipline; the Beijing Rules' preference): the warning-and-admonition; the family-and-community referral (the parents' undertaking, the school's-and-counselling's involvement); the mediation-and-restitution (the victim's repair — the petty offence's settlement); the conditional discharge-and-supervision; the criteria (the minor offence, the first conflict, the child's-and-victim's consent, the community's safety) and the records' non-stigmatising handling. Nepal's practice grows from the Rules'-and-Act's provisions — the exam's frame: diversion is not leniency; it is the system's own discipline against thelabel's harm.
